Healthya Terms of Service
Most important note up front. Healthya is an all-in-one AI assistant for managing your own life — meals, medications, sleep, exercise, appointments, and everyday well-being. It is open to any adult and works fully on its own. In its Family space you can also link with family — letting them see some of your records, viewing what they share with you, or both. It is not a substitute for medical care. For any decisions about your health, please consult a doctor or pharmacist.
1. Acceptance
By installing, launching, or using the Healthya app you accept these Terms and the Privacy Policy. If you do not agree, please do not use the service and uninstall the app.
2. Eligibility
- The service is intended for users 18 years or older.
- If you have a legal guardian, the guardian's consent may be required.
- You may not use the service where prohibited by applicable law.
3. Account and sign-in
- You sign in with your mobile phone number and a one-time SMS code; if the number is new to us, the same step creates your account. Please provide accurate information.
- Accounts are personal and may not be transferred or shared.
- You are responsible for the security of your credentials (password, one-time codes). Do not let others sign in to your account — to let family see your records, use the Family space instead (section 10).
- You may add a security email (for example by confirming it with your Google account). It lets you recover your account if you lose access to your phone number, and it is used as an extra check for sensitive actions such as changing your number or deleting your account.
- You can be signed in to this app on up to three devices at a time. To sign in on a fourth, you choose one of your signed-in devices to sign out. Signing out affects only that device. You can turn on an app lock (PIN or biometrics), which is checked and stored only on your device; if you reset a forgotten app-lock PIN, you are signed out on all your devices.
- Suspected account compromise: contact hello@healthya.app immediately.
4. Acceptable use
The following are prohibited:
- Illegal activity, infringement of others' rights, or input of obscene / violent content
- Unauthorized collection or misuse of other users' data
- Reverse engineering, security circumvention, or bot operation
- Commercial use without our written consent
- In features shared with other people (golf rounds, goal groups): harassing others, impersonating someone, or entering another person’s information without their permission
- Recording, keeping or sharing a linked family member’s records without their consent, or trying to access or take over another person’s account
5. Health information disclaimer
This service is not a medical service. Any health information, meal analysis, meal and snack portion suggestions, medication reminders and drug information, health-checkup report explanations, supplement guidance, mood monitoring, symptom guidance, pet care consultation, care navigation (finding nearby facilities), and first-aid reference provided by Healthya is for general informational purposes and does not replace diagnosis, treatment, or prescription by licensed healthcare professionals.
- Do not start or stop medications based on the service's responses.
- Meal and snack suggestions sized from the height, weight, age, and sex you entered are general wellness guidance — not a prescribed diet, not a weight-loss or weight-gain program, and not nutritional therapy. If you have a condition that affects what you should eat (for example diabetes, kidney disease, heart failure, or difficulty swallowing), follow your clinician's advice rather than the app's suggestions.
- Always consult qualified healthcare providers for medical decisions.
- Symptom guidance and care navigation are general information only — not a medical diagnosis, triage decision, or referral. Nearby-facility results come from third-party map data and may be incomplete or inaccurate.
- Health-checkup report explanations compare your values with the reference ranges printed on your report or, when none are printed, with general U.S. guidelines. They explain your results; they are not a diagnosis. Review your results with the clinician who ordered the test.
- Drug information is a summary of public label data (such as DailyMed and openFDA) and may be incomplete; it does not list every interaction. Follow your pharmacist’s and doctor’s instructions.
- Supplement information and suggestions are general wellness information, not medical advice. Statements about dietary supplements have not been evaluated by the FDA, and supplements are not intended to diagnose, treat, cure, or prevent any disease. Showing a product is not an endorsement, and we do not sell supplements. Check with your doctor or pharmacist before starting one, especially if you take medication.
- Pet care consultation is general information for pet owners, not a veterinary diagnosis. If your pet may be in an emergency, contact a veterinarian or an emergency animal hospital right away.
- The MBTI test in the app is an entertainment and self-reflection feature. Its questions and type descriptions are our own; it is not the official MBTI® instrument (MBTI is a trademark of The Myers & Briggs Foundation), and your result is not a psychological or medical assessment. The app never uses your type for health judgements or recommendations — only to adjust how the AI assistant phrases its replies.
- Information about a linked family member shown in the Family space — including AI-written summaries and suggested things to ask about in reports — is supportive information about their day. It may be inaccurate or out of date and does not replace medical advice about them.
- The service is not certified as a medical device by the FDA or any equivalent authority.
6. AI response limits
- The AI may produce inaccurate or hallucinated content.
- Verify important information before acting on it.
- This includes AI-written travel itineraries and cost estimates, news summaries, lens-camera explanations and translations, and checkup and supplement explanations — they may be wrong or out of date.
- What the AI has learned about you is erased with Erase my records or account deletion; to correct or remove a specific item, contact us (see the Privacy Policy).
- A voice conversation turns itself off after about 20 minutes in which you have not spoken or typed anything; tap to turn it on again. To keep the service available, the number of voice connections one account can open in an hour is limited — if you reach it, voice takes a short break and you can try again a little later. Deleting messages in the AI conversation screen removes them from that screen only (see the Privacy Policy).
7. Emergency features
Healthya is not an emergency call service and not an emergency response service. In emergencies (severe pain, breathing difficulty, falls, self-harm risk) please call 911 (US) or your local emergency number immediately.
- The app provides first-aid reference information (general, pre-written content) and a one-tap 911 dialer. The app opens your phone's dialer; you must place the call yourself — the app does not auto-dial.
- If you grant emergency location sharing to a linked family member, the app keeps a single recent location ready while it is open on your screen and takes a fresh location when you tap 911. Tapping 911 alerts your linked family, and a family member you have granted location sharing can view your most recent location for 24 hours after the alert — see the Privacy Policy for exactly when it is collected, how long it is kept, and who can see it. This is a supportive feature and does not guarantee that family will see it or that help will arrive.
- The emergency home-screen widget opens the app, alerts your linked family right away, and opens the 911 dialer after a 3-second countdown that you can cancel. You still place the call yourself.
- If you receive a family member’s emergency alert, it tells you that they pressed the 911 emergency button in the app — not that a call was placed or answered. Alerts and the emergency location are best-effort: delivery and timeliness are not guaranteed. If you are worried, contact them or emergency services yourself.
- First-aid content is general reference, not personalized medical advice. Follow the instructions of 911 operators and professionals.
8. Connected health apps
- If you enable it, the app reads sleep and sleep stages, steps, distance, activity, workouts, vital signs, blood sugar, weight, and fitness / gait and mental-wellness measurements from Apple Health or Google Health Connect on a read-only basis to improve your daily summary. See the Privacy Policy for the full list.
- This requires your separate OS-level permission and can be turned off at any time in Settings.
- Health-app data is never used for advertising and is never sold (see the Privacy Policy).
9. YouTube videos
- The follow-along workout feature and the condition videos in “Where does it hurt?” play public videos through YouTube’s embedded player and use YouTube API Services. By using these features, you agree to be bound by the YouTube Terms of Service. YouTube’s handling of your information is governed by the Google Privacy Policy.
- The videos belong to their creators and are provided by YouTube. We do not own, download, or edit them, and a video may become unavailable at any time. Ads chosen by YouTube may appear in a video.
- Workout videos are general exercise content, not medical advice or a prescribed program. Stop if you feel pain or dizziness (see section 5). Condition videos are general health information from hospitals, public health bodies, medical societies and licensed clinicians that we select and review; they are not a diagnosis or advice about your own condition. See the Privacy Policy for what is sent to YouTube.
10. Family space
Anyone using Healthya can link with family or someone close to them in the Family space. In each link one person lets the other see some of their records; the same person can be viewed in one link and be the viewer in another.
- Linking. A link starts only when both people agree: the person who wants to view sends a request and accepts the required privacy promise, and the person whose records would be shown accepts it and chooses what to share.
- The person being viewed stays in control. They decide what each linked family member can see, can change it at any time, and can end the link at any time in the app’s Family screen. The viewer can end it at any time with Stop viewing. Ending a link immediately removes the viewer’s access.
- When you view a family member’s records, you agree to use them only to support that person and to keep them confidential: do not take screenshots or recordings of them, copy them, or share them with anyone unrelated to their care without their consent, and use their emergency location only to help them in an emergency — never to monitor their movements. Their records belong to them; you have no independent right to keep or export them, and you may not use them commercially. Misuse of their health information may also breach laws that protect it (for example WA MHMDA, CMIA (CA) and the FTC Act §5), and we may suspend or end your access or your account for it (section 16). See section 6 of the Privacy Policy.
- What you add. You can leave notes on a linked family member’s medication reviews (they can read them) and a short greeting with a link request. Keep them respectful and relevant to their care.
11. Points, games, and shared activities
- Points and badges you earn in the app have no cash value and cannot be sold or transferred. We may correct points awarded in error and may change how points are earned. Any prize or exchange program is offered at our discretion under its own notice.
- For golf games, the app can total side bets (such as skins or stroke bets) from the scores players enter. The app does not hold, collect, or transfer money and is not a party to any bet. Any wagering is solely between the players, who are responsible for following the laws where they play.
- When you start a golf game, the app can suggest the golf course you are at (US courses only) and fill in its holes and par from public course data. This information may be incomplete or out of date, so check the holes and par before you start — once a game starts, its rules are locked. You can always choose another course or enter the holes and par yourself.
- In shared rooms, other participants see your display name (golf) or an automatically generated nickname (goal groups), golf players can record scores for one another, and players added by name only do not need an account. The person who created a room can remove members.
12. Third-party services and links
- Some features open third-party websites or show third-party content inside the app — for example Google Flights for airfares, pages linked from QR codes, information sources, maps and place details, weather, news, and golf course information. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or availability.
- Golf course information comes from OpenStreetMap contributors through OpenGolfAPI and is available under the Open Database License (ODbL); the course picker shows this attribution. It is not our content and we do not guarantee it.
- Bookings or purchases you make on a third-party site are between you and that site. We do not take or process payments.
- A QR code you scan opens its page directly. Check the address before entering personal or payment information.
- For people who use the app in a language other than English, web pages opened inside the app may be shown through Google’s automatic web translation, which may be inaccurate.
13. Your content
- Content you provide (conversations, photos, records, and the notes and greetings you leave for linked family) belongs to you.
- You grant us a non-exclusive, revocable license to store, analyze, and display it as needed to operate the service.
- We do not use your content for advertising or external sale.
- Do not submit content that infringes third-party rights.
14. Intellectual property
All software, design, content, and trademarks of the service belong to us or our licensors. Unauthorized reproduction, distribution, or reverse engineering is prohibited.
15. Fees
- The service offers selected features free of charge.
- If paid subscriptions or one-time purchases are introduced, the checkout screen will display pricing, renewal, and refund terms and require separate consent.
- App Store and Play Store refund policies may take precedence.
16. Termination and account deletion
- You may delete your account at any time in Settings → Delete account. Deletion is scheduled with a 7-day grace period and can be cancelled during it; after that the account and all data are removed. Settings → Erase my records erases your records while keeping the account, on the same 7-day schedule.
- If you ask our team to delete your account instead (for example through the web form on our site), the deletion is scheduled on the same 7-day timeline; to cancel it, contact us during that period.
- Deleting your account also ends your family links, in both directions, when the deletion takes effect.
- We may suspend or terminate an account for violation of these terms (including the confidentiality obligations in section 10), legal compliance, or service discontinuation, with prior notice where feasible.
- Certain records may be retained for statutory periods (see Privacy Policy).
17. Warranty disclaimer
The service is provided "AS IS". To the maximum extent permitted by applicable law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free service.
18. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our cumulative liability shall not exceed the amount you paid in the prior 12 months for the service or USD 100, whichever is greater.
This section does not apply to death or personal injury, fraud, willful misconduct, or any other liability that cannot be limited by applicable law.
19. Dispute resolution
US residents. You agree to resolve disputes by individual binding arbitration under the Federal Arbitration Act (FAA). Class actions and class arbitrations are excluded. You may opt out of this arbitration provision by notifying us in writing within 30 days of accepting these terms.
Other residents. Disputes shall be subject to the exclusive first-instance jurisdiction of the courts in our principal place of business, subject to mandatory consumer protection rights of your jurisdiction.
20. Governing law
US residents: California law. Other residents: mandatory consumer protections of your jurisdiction first, otherwise California law.
21. Changes
Material changes are notified in-app or by email at least 7 days before the effective date. Significant changes require separate consent. If you do not agree, you may delete your account.
