About this policy. The Healthya Family app lets you support a linked senior — view brief health summaries, see optional location information, and receive emergency alerts. This policy explains how we handle your caregiver data and how access to a senior's data works. The senior is the data subject for their own information and is governed by the separate Senior Privacy Policy.

1. Who we are

Healthya Family is operated by Deeper Emptiness AI ("we", "us"), which acts as the business/Controller of your caregiver information. For data of the linked senior, we act as a Service Provider/Processor under instructions defined by the senior's consents.

2. Information about you (the caregiver)

3. Access to the linked senior's data

Once a senior accepts your family link, you can see basic relational facts (their display name, the fact that you are linked). All health activity visibility is gated by a consent the senior grants in their app: Share health activities with family.

3.1 When the senior's health-sharing consent is ON

Meals — time, type (breakfast / lunch / dinner / snack), photo (if uploaded), AI nutrition analysis (food name, calories, caution notes)
Exercise — type and duration (minutes)
Medication — registered medications (name, dose, schedule), intake events, photos of pill bottles / prescriptions
Hydration — water intake events
Sleep — sleep start / end timestamps and sleep stages (including measurements the senior imported from a connected health app)
Device health metrics (if the senior connected a health app) — steps, distance, active energy, vital signs (heart rate, blood pressure, oxygen, temperature, respiratory rate), blood sugar / weight, and fitness / gait measurements imported from Apple Health or Google Health Connect
Recent activity timestamp
AI-generated daily summary of the senior's day, when available — a short written paragraph, the emotional tone the assistant inferred from the senior's conversations (together with its stated reasoning), and the general topics they discussed. The senior's actual words are stripped before the summary is stored, so this is a summary and never a transcript.
Weekly and monthly reports — patterns across the period (meals, medication, sleep, exercise), health-screening flags produced by fixed rules, an AI-written recap, and a monthly summary intended to help prepare for a doctor's visit.

Mental-wellness data (mindfulness minutes and self-logged mood the senior imported from a connected health app) is never visible to family — it is redacted server-side even when the senior's health-sharing consent is on. The same applies to the literal text of the senior's conversations, their AI memory and learned preferences, their voice, their faith affiliation, the height and weight they entered for meal sizing, and their consent history.

The daily summary is sensitive. It describes how the senior seemed to be feeling and what was on their mind. Treat it with the same confidentiality as any other health information about them (see section 8), and remember that they can switch this sharing off at any time.

3.2 Optional location and emergency information

Activity area — a generalized last-7-days activity area (rounded to roughly 1–2 km blocks) is visible only if the senior also grants the separate Share activity area with family consent.
Emergency location — see section 4.

3.3 When the senior's consent is OFF or withdrawn

The family app will display a clear notice that the senior has not granted access, and the related categories are hidden server-side (row-level-security-enforced, not just client filtering). The change is effective on the next data refresh.

3.4 You access this data through the senior's consent

You have no independent right to retain, export, or share the senior's data. If the senior withdraws a sharing consent, the family link itself is unaffected (you remain linked), but the corresponding data visibility is removed.

4. Emergency alerts and location

This app is not an emergency response service. Emergency alerts are best-effort and not guaranteed. In an emergency, call 911 (US) or your local emergency number.

If the senior has granted you emergency location sharing and places a 911 call from their app, you may receive a push alert. The alert notification contains the senior's name only; when you open it, the app retrieves their precise location from our server under row-level security so you can help.

The location you see is the senior's most recent one: their app refreshes a single stored location roughly every 5 minutes while it is open on their screen, so that a usable position exists the moment they need it. Only that one location is stored — each refresh overwrites the last, so there is no trail or history — and it is deleted automatically 7 days after it was last refreshed.

This is not limited to emergencies, and that places a duty on you. Because the location is kept ready in advance, the grant technically lets you open the map and see the senior's most recent location at any time — not only after a 911 call. Please use it only to help them in an emergency. Routine location-checking is not what they agreed to, may breach your confidentiality obligation under section 8 and the Family Terms, and they can withdraw the grant at any moment.

Help the senior recover their account at a new number when authorized (verification by SMS code and your confirmation)

Video calling. Video calling is not offered in the current version of the app. We do not route any video or audio to a video-calling provider.

7. Do Not Sell or Share notice

We do not sell or share your caregiver data, nor the senior's data, for advertising. Protection applies automatically.

8. Confidentiality obligation

You must keep the senior's data confidential. Do not share it with persons unrelated to the senior's care without the senior's prior consent. Misuse of the senior's data violates these Terms and may also violate state privacy laws applicable to the senior (e.g., WA MHMDA, CMIA, and the FTC Act §5).

9. Push notifications

You receive push notifications only for events the senior has approved sharing (e.g., emergency alerts, reminder completion, link approvals). Push delivery is governed by the optional Receive notifications consent. You may disable notifications in-app or in the OS settings at any time. Disabling does not affect the link itself, but you may miss emergency alerts.

10. Retention

Active retention while your caregiver account is in use.
After 24 months of inactivity we will notify and deactivate.
Account deletion: caregiver data removed within 30 days. Senior data access ceases immediately upon unlink — we do not retain copies on your device.

11. Your rights

You have the same set of rights (Know, Delete, Correct, Portability, Limit SPI, Opt-Out of Sale, Opt-Out of ADM, Non-Discrimination, Appeal, Authorized Agent) over your own caregiver data as set out in the Senior Privacy Policy. You do not have rights of access, correction, or deletion over the senior's data via the family app — please direct the senior to exercise those rights from their own app. Because the Family app does not include an in-app data export, exercise your own rights (including the Right to Know) by email at hello@healthia.app with the subject line [Rights Request]; we verify your identity and respond within 45 days.

12. Biometric notice (Illinois BIPA)

We do not generate or store voiceprints or other biometric identifiers from your audio or video.

13. Security

We implement reasonable technical and administrative safeguards (encryption in transit and at rest, row-level security, access control, audits) consistent with the NY SHIELD Act and industry standards.

14. International transfers

The service operates in multiple countries including the United States. Information may be transferred internationally; the higher of local law or this policy applies.

15. Changes to this policy

Material changes are notified in-app and by email at least 7 days before effective date. Significant scope changes require renewed consent.

1. 회사 정보

Healthya Family는 Deeper Emptiness AI("당사")가 운영하며, 당사는 보호자 정보의 사업자/처리자(Controller)입니다. 연결된 시니어의 데이터에 대해서는 시니어의 동의로 정의된 지시에 따라 서비스 제공자/수탁자(Processor)로서 처리합니다.

3. 연결된 시니어 데이터 접근

시니어가 가족 연결을 수락하면, 기본적인 관계 정보(닉네임, 연결되어 있다는 사실)를 볼 수 있습니다. 모든 건강 활동의 노출은 시니어가 자신의 앱에서 부여하는 가족과 건강 활동 공유 동의로 통제됩니다.

3.1 시니어의 건강 공유 동의가 켜져 있을 때

식사 — 시각, 종류(아침/점심/저녁/간식), 사진(업로드 시), AI 영양 분석(음식명, 칼로리, 주의 메모)
운동 — 종류와 시간(분)
복약 — 등록 약(이름, 용량, 일정), 복용 기록, 약통/처방전 사진
수분 — 물 섭취 기록
수면 — 수면 시작/종료 시각 및 수면 단계(시니어가 건강 앱에서 가져온 측정값 포함)

가능한 경우 시니어 하루에 대한 AI 생성 요약 — 하루를 서술한 짧은 문단, 시니어의 대화에서 추론된 감정 상태(추론 근거 포함), 그리고 이야기한 주제. 시니어의 실제 발화 문장은 저장 전에 제거되므로, 대화록이 아니라 요약입니다.
주간·월간 리포트 — 기간 동안의 패턴(식사·복약·수면·운동), 정해진 규칙으로 산출된 건강 스크리닝 플래그, AI 작성 요약, 그리고 진료 상담 준비를 돕기 위한 월간 요약

정신건강 데이터(시니어가 건강 앱에서 가져온 마음챙김 시간과 본인이 기록한 기분)는 시니어의 건강 공유 동의가 켜져 있어도 서버에서 제거되어 절대 가족에게 표시되지 않습니다. 시니어 대화의 실제 문장, AI 기억과 학습된 선호, 음성, 종교·신앙, 식사량 조정을 위해 입력한 키·몸무게, 동의 이력도 마찬가지로 표시되지 않습니다.

하루 요약은 민감한 정보입니다. 시니어가 그날 어떤 기분이었는지, 무엇을 마음에 두고 있었는지가 담깁니다. 다른 건강정보와 동일한 수준의 기밀로 다루어 주시고(8항 참조), 시니어는 언제든 이 공유를 끌 수 있다는 점을 기억해 주세요.

3.2 선택적 위치 및 응급 정보

활동 영역 — 최근 7일의 일반화된 활동 영역(약 1~2 km 블록 단위로 반올림)은 시니어가 별도의 가족과 활동 영역 공유 동의를 부여한 경우에만 표시됩니다.
응급 위치 — 4항 참조.

3.3 시니어의 동의가 꺼져 있거나 철회된 경우

가족 앱은 시니어가 접근을 허용하지 않았음을 명확히 안내하며, 관련 항목은 서버에서 숨겨집니다(클라이언트 필터링이 아닌 행 수준 보안으로 강제). 변경은 다음 새로고침 시 반영됩니다.

3.4 시니어의 동의를 통해서만 접근

보호자는 시니어 데이터를 독자적으로 보관·내보내기·공유할 권리가 없습니다. 시니어가 공유 동의를 철회해도 가족 연결 자체는 유지되지만, 해당 데이터의 노출은 제거됩니다.

4. 응급 알림 및 위치

본 앱은 응급 대응 서비스가 아닙니다. 응급 알림은 최선의 노력일 뿐 보장되지 않습니다. 응급 상황에서는 911(미국) 또는 현지 응급번호로 전화하세요.

시니어가 보호자에게 응급 위치 공유 권한을 부여한 상태에서 자신의 앱으로 911을 발신하면, 보호자에게 푸시 알림이 올 수 있습니다. 알림에는 시니어 이름만 담기며, 알림을 열면 앱이 시니어의 정밀 위치를 당사 서버에서 행 수준 보안으로 가져와 보여줍니다.

표시되는 위치는 시니어의 가장 최근 위치입니다. 시니어의 앱은 필요한 순간에 쓸 수 있는 위치가 확보되어 있도록, 앱이 화면에 열려 있는 동안 약 5분마다 저장된 위치 1건을 갱신합니다. 저장되는 위치는 이 1건뿐이며 갱신 시 이전 값을 덮어쓰므로 이동 경로나 이력은 남지 않고, 마지막 갱신 시점으로부터 7일 후 자동 삭제됩니다.

응급 상황에만 한정되지 않으며, 그만큼 보호자에게 의무가 따릅니다. 위치가 미리 확보되어 있기 때문에, 권한이 있으면 911 발신 이후가 아니어도 기술적으로는 언제든 지도를 열어 시니어의 최근 위치를 볼 수 있습니다. 응급 시 시니어를 돕는 용도로만 사용해 주세요. 일상적인 위치 확인은 시니어가 동의한 범위가 아니며, 8항 및 가족 이용약관의 기밀 유지 의무 위반이 될 수 있고, 시니어는 언제든 권한을 철회할 수 있습니다.

7. 판매·공유 금지 고지

당사는 보호자 데이터나 시니어 데이터를 광고 목적으로 판매·공유하지 않습니다. 보호가 자동 적용됩니다.

8. 기밀 유지 의무

시니어 데이터를 기밀로 유지해야 합니다. 시니어의 사전 동의 없이 돌봄과 무관한 사람과 공유하지 마세요. 시니어 데이터 오용은 본 약관 위반이며, 시니어에게 적용되는 주(州) 프라이버시법(예: WA MHMDA, CMIA, FTC Act §5)도 위반할 수 있습니다.

9. 푸시 알림

시니어가 공유를 승인한 이벤트(예: 응급 알림, 알림 완료, 연결 승인)에 대해서만 푸시 알림을 받습니다. 푸시 전달은 선택 항목인 알림 수신 동의로 통제됩니다. 앱 또는 OS 설정에서 언제든 알림을 끌 수 있습니다. 끄더라도 연결 자체에는 영향이 없으나, 응급 알림을 놓칠 수 있습니다.

10. 보유 기간

보호자 계정 이용 중에는 활성 보유.
24개월 미사용 시 통지 후 비활성화.
계정 삭제: 보호자 데이터는 30일 이내 삭제. 연결 해제 시 시니어 데이터 접근은 즉시 중단되며, 기기에 사본을 보관하지 않습니다.

11. 이용자의 권리

보호자 본인 데이터에 대해 시니어 개인정보처리방침에 기재된 것과 동일한 권리(알 권리, 삭제, 정정, 이동, SPI 제한, 판매 옵트아웃, 자동화 의사결정 옵트아웃, 차별 금지, 이의제기, 대리인)를 가집니다. 가족 앱을 통해 시니어 데이터에 대한 접근·정정·삭제 권리는 갖지 않으며, 해당 권리는 시니어가 자신의 앱에서 행사하도록 안내해 주세요. 가족 앱에는 인앱 데이터 내보내기 기능이 없으므로, 본인 권리(알 권리 포함)는 hello@healthia.app으로 제목 [Rights Request] 이메일을 보내 행사해 주세요. 신원 확인 후 45일 이내 처리합니다.

12. 생체정보 고지(일리노이 BIPA)

당사는 보호자의 음성·영상으로부터 음성 지문 등 생체 식별자를 생성·저장하지 않습니다.

13. 보안

당사는 전송·저장 시 암호화, 행 수준 보안, 접근 통제, 감사 등 합리적인 기술적·관리적 보호조치를 NY SHIELD Act 및 업계 표준에 부합하게 적용합니다.

14. 국외 이전

본 서비스는 미국을 포함한 여러 국가에서 운영됩니다. 정보가 국외로 이전될 수 있으며, 그 경우 현지법과 본 방침 중 더 높은 보호가 적용됩니다.

15. 방침 변경

중대한 변경은 시행일 최소 7일 전 앱 내 및 이메일로 통지합니다. 중대한 범위 변경은 재동의가 필요합니다.
